These terms explain the rules for using ENSO Atlas + Radar (“the app”), on the web or as an installed app. By using the app, you agree to them. If you don’t agree, please don’t use the app.

The most important part: this is not a warning service

The app shows patterns from past weather, model forecasts and other public data. It does not forecast individual storms and does not issue watches or warnings. Its outlooks are statistical guides that are often wrong, and its radar and data can be delayed, incomplete or unavailable.

Never rely on the app to keep yourself or anyone else safe. For watches, warnings and emergencies, follow the National Weather Service (weather.gov), local radio and TV, emergency alerts on your phone and local officials. Storm chasing is dangerous; you are responsible for your own safety and decisions.

1. What the app is

The app is an information and education tool. It shows El Niño and La Niña conditions and outlooks, what past years with similar conditions were followed by, live radar and storm-ingredient maps, and related data. Nothing in the app is professional, safety, financial, insurance, agricultural or legal advice.

2. No guarantees

The app is provided “as is” and “as available”, without warranties of any kind, whether stated or implied, including any promise that it is accurate, complete, up to date, uninterrupted, error-free or fit for a particular purpose. Outlooks are based on history and models, and the future can turn out very differently. The app shows its own track record so you can judge how much to trust it.

3. Data from other sources

Much of what the app shows comes from outside sources, including NASA, NOAA (the National Weather Service, Storm Prediction Center, National Hurricane Center and Climate Prediction Center), the Iowa Environmental Mesonet and OpenStreetMap. We don’t control those sources, can’t guarantee their data, and aren’t responsible if they change, are wrong or stop working. Links to other websites are provided for convenience only.

4. Using the app fairly

You may use the app for your own personal, non-commercial purposes. Please don’t:

We may limit or block access for anyone who doesn’t follow these rules.

5. Changes to the app

We may change, add or remove features, or pause or stop the app, at any time and without notice. If paid features are offered in future, their price and terms will be shown before you buy.

6. Who owns what

The app’s design, code, name, logo and text belong to its owner. Public-domain data (such as NOAA and NASA data) stays free for everyone; map data is © OpenStreetMap contributors. Sharing a link or a report image made with the app’s Share or Save buttons is welcome.

7. Limits on our responsibility

To the fullest extent the law allows, the app’s owner will not be responsible for any loss, damage, injury or cost arising from using the app or relying on anything in it, including decisions about travel, storm chasing, property, business or safety, and including indirect or consequential losses. Where the law does not allow responsibility to be excluded entirely, it is limited to the amount you paid for the app in the 12 months before the claim, or US $10 if you paid nothing.

8. Age

The app is meant for people aged 13 and over. If you are under 18, please use it with a parent or guardian’s permission.

9. Privacy

How the app handles information is explained in the Privacy Policy, which is part of these terms.

10. Changes to these terms

We may update these terms. The date at the top shows the latest version, and continuing to use the app after a change means you accept the updated terms.

11. Law and contact

These terms are governed by the laws of the United States and the State of South Dakota. If any part of them can’t be enforced, the rest still applies.
